Navigating India’s updated labour framework is essential for business leaders, HR teams, and employees. The modern codes overhaul legacy rules around minimum wages, national floor wages, fixed-term roles, social security access, gig platforms, workplace safety, and migrant worker rights.

  • For Employers: Staying current ensures compliance, smooth salary restructuring, accurate Provident Fund (PF) and gratuity allocations, and aligned employment contracts.

  • For Employees: Understanding these rules helps you verify take-home pay, understand your rights, access social security, and expect fair workplace conditions.

Below are direct answers to the most critical questions surrounding India’s updated labour framework.

Core Framework & Implementation

1. What are the four new labour codes?

The reform consolidates 29 central labor statutes into four streamlined codes:

  • The Code on Wages

  • The Industrial Relations Code

  • The Code on Social Security

  • The Occupational Safety, Health, and Working Conditions (OSHWC) Code

Together, these codes establish a unified legal structure governing compensation, working conditions, dispute resolution, social benefits, and workplace safety.

2. When do these labour codes take effect?

The overarching framework took effect on November 21, 2025. Because labor regulations are managed jointly by central and state authorities, full operational implementation relies on state-level notifications published through April 2026. Organizations must track state-specific bulletins closely to keep local payroll and HR policies compliant.

Wages, PF & Gratuity Calculations

3. How does the 50% Wage Rule under the Code on Wages work?

The Code on Wages standardizes how “wages” are defined for calculating statutory benefits. Under the 50% Wage Rule, at least 50% of an employee’s total Cost to Company (CTC) must consist of basic pay and qualifying allowances.

4. What components are excluded from “wages”?

Standard exclusions include:

  • House Rent Allowance (HRA)

  • Conveyance/travel allowances

  • Employer PF and ESI contributions

  • Special expense reimbursements and statutory bonuses

Crucial Rule: If the combined total of these excluded allowances exceeds 50% of the employee’s total remuneration, the excess amount automatically gets added back into the wage base for statutory calculations.

5. What changes occur with Provident Fund (PF) and Gratuity calculations?

  • Higher PF Contributions: Because PF is calculated on a broadened wage base (minimum 50% of CTC), both employee withholdings and employer contributions increase.

  • Increased Gratuity Payouts: Gratuity uses the widened wage definition, raising final payout balances upon exit.

  • Pro-Rated Gratuity for Contract Roles: Fixed-term workers earn pro-rated gratuity eligibility if their contract completes naturally after one year.

  • Simplified Compliance: Standardized wage definitions eliminate past confusion regarding which specific allowances count toward gratuity.

Coverage, Contract Workers & Social Security

6. Who is impacted by these new rules?

The codes cover the entire modern workforce landscape:

  • Full-time salaried employees and fixed-term contract staff

  • Independent contractors and agency workers

  • Digital gig platform drivers, delivery partners, and freelancers

  • Interstate migrant workers and unorganized sector labor

7. Are gig and platform workers covered under social security?

Yes. The Code on Social Security formally defines gig and platform workers. It establishes a National Social Security Board and dedicated funding pools (backed by aggregator contributions) to cover health, disability, accident, maternity, and retirement benefits.

8. How is fixed-term employment recognized?

Fixed-term employment allows companies to hire employees directly on fixed-duration contracts without third-party staffing agencies. Key benefits include:

  • Equal wages, medical benefits, and amenities as permanent employees in similar roles.

  • Statutory gratuity eligibility after one year of continuous service, rather than the traditional five-year threshold.

9. Are there special provisions for inter-state migrant workers?

Yes. The OSHWC Code grants specific protections for interstate migrant employees:

  • Portal-based registration for portable social welfare access.

  • Employer obligations to provide journey allowances and maintain records for housing arrangements.

Workplace Safety & Employer Obligations

10. What is covered under the OSHWC Code?

The Occupational Safety, Health, and Working Conditions (OSHWC) Code consolidates 13 older workplace safety laws into a single framework. Key provisions mandate:

  • Standards for workplace sanitation, clean drinking water, ventilation, and first aid.

  • Regulated daily work hours and double-rate overtime pay rules.

  • Single-window web registration for business establishments.

  • Employer accountability for mandatory annual health check-ups for eligible staff.

11. What immediate steps should employers take?

  1. Audit Payroll: Recalculate salary structures to ensure basic pay meets the 50% wage baseline.

  2. Review Contracts: Update offer letters, contractor agreements, and fixed-term templates.

  3. Monitor State Notifications: Track state rule updates published through April 2026.

  4. Upgrade HR Software: Ensure payroll software automatically computes dynamic statutory deductions.

12. Which specific contract sections require updates?

  • Compensation Structure: Clarify basic salary, allowances, and the revised 50% wage threshold.

  • Fixed-Term Rules: Specify contract tenure, benefit parity, and pro-rated gratuity eligibility.

  • Hours & Overtime: Detail work schedules, rest breaks, and overtime rate formulas.

  • Social Security References: Update terms covering PF, ESI, pension, and gratuity entitlements.

  • Dispute & Exit Clauses: Align notice periods and disciplinary actions with the Industrial Relations Code.

13. What are the penalties for non-compliance?

The codes establish a tiered penalty framework for wage, safety, contract, or reporting violations. Penalties range from monetary fines to legal prosecution for repeated offenses. Digital audit trails and automated web inspections mean multi-state businesses must maintain accurate, audit-ready records at all times.

Conclusion

Adapting to India’s updated labour framework requires proactive alignment rather than reactive fixes. Restructuring salary models, updating employment contracts, and utilizing automated payroll systems ensures seamless statutory compliance while building long-term trust with your workforce.
